Property Settlement

Your Property Settlement is probably one of the biggest challenges you will face dealing with your Family Law matter. Property Settlements can be complex and time consuming. You have invested heavily in your relationship. Not only has it cost you in blood, sweat and tears, either together or separately, you have made contributions towards the things that you both own.

The Family Law Act 1975 (Cth) determines that ‘property’ encompasses all assets owned by both people in the relationship. This includes cash, cars, real estate, businesses, shares in companies, superannuation, trusts, overseas assets, and more! All property is collated together into the ‘property pool.’

Property Settlements are not about one person walking away with the lot or splitting everything down the middle. The Property Settlement process is about looking at your individual property pool and determining what split is fair in your circumstances. To do this we look to the past to see how you both got the property that you have, then to the future to make sure that each party has a similar opportunity to bounce back financially after the separation.
